These terms govern the use of the ClearBerth service, published by SAW SOLUTIONS. Creating an account means accepting them.

1. Service

ClearBerth checks the consistency of shipping documents (packing list, House B/L, Master B/L, commercial invoice, EUR.1 certificate) and produces a report listing the discrepancies found.

The service is intended for professionals: freight forwarders, customs brokers, importers and exporters.

2. Account

An account is opened for one company, identified by its name and tax identifier: one company, one account. The administrator invites the users and remains responsible for their use of the service.

Users keep their credentials confidential. Any use made with them is deemed to be made by the customer.

3. Trial and plans

The trial covers 5 analysed shipments, free of charge and with no card required.

The paid plans, their price and their monthly volume are shown on the pricing page, which forms part of these terms. Prices are in euros, excluding taxes.

A shipment is counted when its analysis is first run. Re-running it after correcting or completing its documents is free; it only counts again when all its documents have been replaced.

When the quota is reached, new analyses are paused until the next period or a change of plan. Shipments and reports remain available.

4. Payment, change of plan and cancellation

Paid plans are billed monthly in advance, or yearly when this option is chosen. Until online payment is available, an invoice is sent to the customer.

The customer may move to a larger plan at any time; the change takes effect immediately. A reduction or a cancellation takes effect at the end of the current period and is requested by writing to us.

Any period started is due. The trial requires no cancellation.

5. Role of the service and responsibilities

ClearBerth is a verification aid. It never validates a shipment on the customer's behalf: the decision to present a shipment to customs, and the stamp, remain with the customer's user, who compares the report with the source documents.

ClearBerth makes every reasonable effort to detect discrepancies but does not guarantee that every error will be found, nor the decisions of customs administrations or carriers.

The customer is responsible for the documents it uploads and for having the right to transmit them.

Except in cases of gross negligence or wilful misconduct, the liability of the publisher is limited to the amounts paid by the customer over the twelve months preceding the event giving rise to the claim.

6. Data

Documents and reports belong to the customer. The publisher processes them only to provide the service, in accordance with the privacy policy.

At the end of the contract, the customer may ask for its data to be deleted; it is deleted at the latest twelve months after the end of the contract.

7. Availability

The service is available at all times, except for maintenance and events beyond the publisher's control. Planned maintenance is carried out whenever possible outside business hours.

8. Changes to these terms

These terms may change. The customer is informed of any substantial change at least thirty days before it takes effect and may cancel before that date.

9. Governing law and disputes

These terms are governed by le droit français. Failing an amicable settlement, any dispute falls within the jurisdiction of les juridictions compétentes du ressort de Lyon.
